Old registration system will deter new investment

AN expert in property registration has warned that the Government must act quickly to improve Ireland’s property registration system and increase online access to title deeds.

John Deeney, land registration consultant at the legal firm of McDowell Purcell and former deputy registrar in the property registration authority, highlighted that Ireland’s outdated property registration system is affecting its global ranking for ease of doing business and could be deterring commercial buyers.

Government issues Guidelines on Loft Conversions

Converting the roof space may be a convenient  way of obtaining additional living space in
an existing dwelling house, without extending into the garden. However there are many issues to be resolved before any works are carried out. There is a legal requirement to comply with Building Regulations, including those related to fire safety. The purpose of these fire safety requirements is to safeguard you and your family, should a fire occur in your home.

Before deciding to carry out any works, an assessment of the feasibility of achieving the required accommodation and complying with the statutory requirements (including fire safety requirements) should be made. ABL Surveyors can provide you with professional advice on the design of your attic conversion, following through to the the selection of a
competent contractor, the supervision of the conversion work, the certification of payment instalments to the builder, and the certification of the completed conversion as being in compliance with applicable Planning / Building Regulations. New Septic Tank Inspection Legislation

The Department of the Environment recently published an information leaflet for home owners who have septic tanks. The leaflet sets out the relevant legislation and give households background on the procedures put in place for registration and inspection of private waste water treatment systems.

In summary, The Water Services (Amendment) Act 2012 provides for the introduction of a registration and inspection system for domestic wastewater treatment systems. It has been introduced to address the European Court of Justice ruling against Ireland in October 2009, and even more importantly, to protect ground and surface water quality (particularly drinking water sources) from the risks posed by malfunctioning systems.

Inspections will commence after the end of the registration period in 2013 and will be objective and evidence-based. The Department says that householders can be assured that if their systems are working properly and are being maintained, they need not be concerned. There will be a proportionate and risk-based approach to inspections, which will be targeted towards areas where drinking water sources or habitats are at risk from septic tank discharges.

Report of The Pyrite Panel

The Department of the Environment recently published the long awaited report on the issue of Pyrites.
The issue of pyrite heave first came to the attention of the Department of the Environment in mid-2007 by way of representations from politicians and in media coverage. Initially it was thought that the problems were confined to a number of private housing developments in the Fingal County Council area where the sub-floor hardcore fill was reported to contain a naturally occurring mineral known as “pyrite”. However, it soon became clear that the problem was more widespread and it later transpired the problem of pyrite heave was evident in five local authority areas, Fingal, Dublin City, Meath, Kildare and Offaly.

House prices due to fall sharply in wake of pandemic

House prices are likely to fall sharply over the next year, a leading think tank has predicted.

The Economic and Social Research Institute (ESRI) has warned that prices are set to plunge by 12pc by the end of next year, with the property market likely to be sluggish over the next year and a half.

Economic impacts from the virus will have a huge dampening effect on house prices, particularly the drop in household income and the surge in unemployment.

Covid-19: Property industry and insurers must grapple with pandemic risk

Covid-19 has meant shuttering multiple business premises across the State. Yet tenants must continue to pay their rent and landlords must continue to service their borrowings. Real estate lawyers in common law jurisdictions have quickly reached a broad consensus around the legal realities of this situation.

First, tenants are unlikely to be able to walk away from their lease obligations. Most leases have no “force majeure” provisions and the shutdown is unlikely to amount to “frustration” (a view supported by a Hong Kong case arising from the 2002 Sars [Severe acute respiratory syndrome] outbreak). Second, landlords and tenants will find that the standard definition of “insured risks” for buildings insurance is of no assistance. Policies are typically concerned only with losses arising from physical damage and so even “loss of rent” cover is of no use.

David McWilliams: Want to fix the housing crisis? Tax land

In June 1858, during the second Opium War, Britain and France, in cahoots with the other major European powers and the United States, forced China to sign the Treaty of Tianjin. Britain waged the Opium War so its merchants could flood China with cheap heroin, cultivated by other British merchants in India.

The treaty allowed western trading powers to annex China commercially, emasculate the emperor and carve up the vast wealth of the Middle Kingdom. The Europeans colonised the mainland from the east, while the resurgent US navy, fresh from annexing California from Mexico, moved across the Pacific from the west.

These events were watched with distress in Edo, as Tokyo was then known. In 1860 Japan was isolated, feudal and weak. It was an obvious next commercial target for avaricious westerners. If India and China could be enfeebled by imperialists, what chance had remote Japan?

But Japan didn’t go the way of China. By 1900 Japan had become the most advanced independent nation in Asia. By 1905 it was trouncing the Russians on the battlefield.
